1. scope

These General Terms and Conditions (GTC) of The Beauty Group by Beata Feher – My Natural Skincare, Plattenstrasse 5, 9444 Diepoldsau SG, Switzerland (hereinafter “My Natural Skincare”), apply to the sale of products via the online shop www.lamianatura.ch.

The following General Terms and Conditions (GTC) apply between My Natural Skincare and its customers in the version currently available and valid when the website is accessed or when goods are ordered or a contract is concluded.

My Natural Skincare sells natural cosmetic products in particular through its online shop at www.lamianatura.ch.

A customer is defined as any natural or legal person who maintains a business relationship with My Natural Skincare via the online shop at www.laminatura.ch. The general terms and conditions, the delivery and payment conditions and the data protection provisions may be adjusted from time to time.

My Natural Skincare ships its products exclusively to customers residing in Switzerland.

These terms and conditions apply exclusively. Any conflicting, supplementary or deviating terms and conditions require the express written confirmation of My Natural Skincare in order to be valid.

When using the website www.lamianatura.ch or when ordering goods or concluding a contract, the customer confirms that he or she fully accepts these General Terms and Conditions, including the delivery and payment conditions.

For reasons of better readability, the male form is used for personal names and special nouns in these terms and conditions. In the interests of equal treatment, corresponding terms generally apply to all genders. The shortened form of language is for editorial reasons only and does not imply any evaluation.

2. Information at www.lamianatura.ch

www.lamianatura.ch contains information about products. Prices and product ranges are subject to change. All information on www.lamianatura.ch (product descriptions, images, films, dimensions, weights and other information, except prices) is non-binding and in particular does not represent any assurance of properties or guarantees, unless explicitly stated otherwise. My Natural Skincare endeavors to provide all information and details on this website correctly, completely, up-to-date and clearly arranged, but My Natural Skincare cannot provide any guarantee for this, either expressly or implicitly.

All offers on www.lamianatura.ch are subject to change and are not to be understood as binding offers.

My Natural Skincare cannot guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and can change at any time and without notice.

3. Prices

The prices quoted by My Natural Skincare include VAT unless otherwise stated.

Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately during the ordering process. Shipping is free for orders over CHF 150.—.

Technical changes, errors and misprints are reserved. In particular, My Natural Skincare may change prices at any time and without prior notice. The sales prices do not include any consulting or support services.

4. Conclusion of contract

The offers on www.lamianatura.ch represent an invitation to the customer to order products. By ordering via www.lamianatura.ch, including acceptance of these terms and conditions, the customer makes a legally binding offer to conclude a contract. My Natural Skincare then sends an order confirmation by email, which confirms that the customer's offer has been received by My Natural Skincare. The contract for the purchase of the product is concluded upon delivery of this order confirmation.

Orders will be delivered provided the products are available. If it becomes apparent after the contract has been concluded that the ordered products cannot be delivered or cannot be delivered in full, My Natural Skincare is entitled to withdraw from the entire contract or from part of the contract. If the customer's payment has already been received by My Natural Skincare, this will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay. My Natural Skincare is not obliged to provide a replacement delivery in the event of a contract termination.

5. Right of withdrawal

The customer is granted a right of withdrawal for 14 days after receipt of the product. This period is deemed to have been met if the customer returns the product to My Natural Skincare within 14 days of receipt.

Exercising the right of withdrawal will result in the contract being reversed. The customer must return the product in its original packaging, unopened and complete with all accessories and together with the delivery note. Returns to My Natural Skincare are at the customer's expense and risk. Any payment already made will be refunded to the customer within 14 days, provided that My Natural Skincare has already received the product back.

My Natural Skincare reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the loss in value from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

1. if the product has been opened or if the packaging is damaged or missing when returned;
2. if the contract has an element of chance, in particular because the price is subject to fluctuations over which My Natural Skincare has no control;
3. if the contract concerns a movable item which, due to its nature, is not suitable for return or is liable to spoil quickly;
4. if the contract concerns a movable item which is manufactured according to the consumer’s specifications or is clearly tailored to his personal needs.

6. Payment options and retention of title

The customer has access to the payment options specified during the ordering process.

My Natural Skincare reserves the right to exclude customers from certain payment options and/or to demand payment in advance without giving reasons.

7. Delivery, obligation to inspect, notification of defects and return

Deliveries are sent to the address specified by the customer in the order. Orders are usually dispatched on the following working day. If a longer delivery time is foreseeable, the customer will be informed promptly. If the address details are incorrect and the package cannot be delivered and/or is returned, the delivery service provider will charge fees of CHF 5.— to CHF 10.—, which My Natural Skincare will invoice the customer. These fees are also owed by the customer if My Natural Skincare subsequently withdraws from the purchase contract (see section 4 above).

Upon dispatch, benefit and risk are transferred to the customer.

If the delivery cannot be made or if the customer refuses to accept the delivery, My Natural Skincare can terminate the contract after sending a notice of complaint by email to the customer and setting a reasonable deadline and invoice the costs for the effort.

The customer is obliged to inspect the delivered product immediately upon receipt of the delivery and to immediately notify My Natural Skincare in writing by letter or email of any defects for which My Natural Skincare provides a guarantee.

Returns to My Natural Skincare are at the customer's expense and risk. The customer must send the product to My Natural Skincare in its original packaging, unopened and complete with all accessories, together with the delivery note and a description of the defects.

If My Natural Skincare's inspection reveals that the product has no detectable defects or that these are not covered by the manufacturer's warranty, My Natural Skincare may charge the customer for the costs of returning the product or any disposal.

9. Warranty

My Natural Skincare strives to deliver products of impeccable quality. In the case of defects reported in a timely manner, My Natural Skincare guarantees that the product purchased by the customer is free from defects for a period of one year from the delivery date, but no later than the expiration date announced by the manufacturer. It is at My Natural Skincare's discretion to provide the guarantee by providing an equivalent replacement or by refunding the purchase price. Further claims are excluded.

The warranty does not cover the consequences of improper handling or damage by the customer or third parties, nor does it cover defects that are due to external circumstances.

10. Liability

My Natural Skincare excludes all liability, regardless of its legal basis, as well as claims for damages against My Natural Skincare and any auxiliary persons and vicarious agents. In particular, My Natural Skincare is not liable for indirect damage and consequential damage, lost profits or other personal, material and purely financial damage to the customer. Further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.

All My Natural Skincare products are for cosmetic purposes only. Any liability is rejected for any other use.

My Natural Skincare uses hyperlinks solely to simplify the customer's access to other web offerings. My Natural Skincare cannot know the content of these web offerings in detail nor can it accept liability or other responsibility for the content of these websites.

My Natural Skincare is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties who are not owned by My Natural Skincare.

11. Further instructions

My Natural Skincare expressly reserves the right to change these Terms and Conditions at any time and to put them into effect without notice.

Should individual provisions of these General Terms and Conditions be invalid and/or ineffective in whole or in part, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that come closest to the meaning and purpose of the invalid and/or ineffective provisions in a legally effective and economic manner. The same applies to any gaps in the regulation.

In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is St. Gallen, unless the law provides for mandatory places of jurisdiction.
